1. Agreement
These Terms of Service ("Terms") govern your use of the website at treeimpressions.com and any tree care services performed by Tree Impressions of Florida Environmental Services LLC ("we," "us," "our," or "Tree Impressions"). By using our website, requesting an estimate, or engaging our services, you ("you" or "customer") agree to be bound by these Terms. If you do not agree, please do not use our website or services.
These Terms, together with any written estimate, service agreement, or invoice we provide, form the complete agreement between you and Tree Impressions for the work being performed. In the event of a conflict between these Terms and a signed service agreement, the signed agreement controls for that specific job.
2. Services Description
Tree Impressions provides tree care services in Pinellas County, Florida, including but not limited to tree removal, tree trimming and pruning, stump grinding, emergency storm response, crane and bucket-truck removals, climber services, tree cabling and bracing, tree replanting, bobcat and lot clearing, and mulch delivery and installation. The specific services to be performed for any customer are set out in the written estimate or service agreement for that job.
We reserve the right to decline work that we determine to be unsafe, outside our scope of practice, or otherwise inappropriate. Where we identify a safer alternative to the work originally requested, we will discuss it with you before proceeding.
3. Estimates and Quotes
Estimates and quotes are non-binding informational documents until both parties agree in writing (including by signed estimate or by your acceptance via email or text confirming the work) to proceed. All pricing is subject to verification on site at the time of work — significant changes in scope, hidden conditions discovered during the job, or material misrepresentation of the property may result in a revised quote, which will be presented to you for approval before additional work is performed.
Unless otherwise specified in writing, written estimates are valid for thirty (30) days from the date issued. Pricing after that period may be subject to revision based on current labor, equipment, and disposal costs.
4. Service Performance
We perform all work in a workmanlike manner and in accordance with applicable industry standards, including ANSI A300 standards for tree care operations and ANSI Z133 for safety practices. We carry appropriate equipment for the work being performed and use trained crew members on every job.
Scheduling may be affected by weather, equipment availability, prior emergency work, or other factors outside our reasonable control. We will communicate scheduling changes promptly. Customer is responsible for providing accurate property information including, where relevant, the location of underground utilities, irrigation lines, septic systems, and any other site features that could affect the work or be affected by it.
5. Payment Terms
Unless other arrangements are made in writing, payment is due upon completion of the work. We accept cash, check, major credit cards, and electronic payment methods specified at the time of invoicing. Invoices unpaid after thirty (30) days from issuance may accrue a late fee at the maximum rate permitted by Florida law, and unpaid balances may be subject to collection costs and reasonable attorneys' fees as permitted by law.
For larger projects, we may require a deposit before scheduling. Deposit terms will be set out in the written estimate. Deposits are non-refundable in the event the customer cancels work after materials have been ordered or specialized equipment has been reserved.
6. Property Access and Damage
By scheduling work, you grant Tree Impressions and its crew permission to access your property for the purpose of performing the agreed-upon services. Tree care work necessarily involves heavy equipment, debris, and worker presence on your property. Some incidental disturbance — such as minor lawn impressions from outrigger pads, footprints, or temporary debris — is unavoidable and is not considered damage.
Tree Impressions carries general liability insurance and workers' compensation coverage. Our insurance covers damage caused by our negligence or fault during the performance of the work. We are not responsible for: (a) pre-existing damage or conditions; (b) damage caused by hidden conditions you did not disclose (for example, undocumented underground utilities or fragile landscape features); (c) damage caused by acts of God, weather, or third parties; or (d) damage to landscape features that have been clearly identified to you as at risk before work began.
Any damage claim must be reported to Tree Impressions in writing within seventy-two (72) hours of completion of the work. We will investigate promptly and, where damage was caused by our negligence, repair or compensate at our option.
7. Cancellation
We request at least 24 hours' notice for the cancellation or rescheduling of non-emergency work, so that we can offer the slot to other customers. Last-minute cancellations after a crew has been dispatched may result in a dispatch fee covering the time and travel costs incurred.
For emergency calls, the dispatch of a crew is itself the engagement. If an emergency call is cancelled after the crew is en route or on site, a dispatch fee will apply to cover labor and travel time.
8. Warranties and Disclaimers
We warrant that work will be performed in a workmanlike manner and in accordance with industry standards. Beyond that, we make no warranties, express or implied, regarding the future condition of any tree, the success of any pruning or cabling intervention, the prevention of future failure or storm damage, or the rate of secondary growth or sucker production after removal.
Specifically, we do not warrant: (a) that any tree will survive after pruning, cabling, or replanting work, as tree health depends on factors outside our control; (b) that storm-damaged or structurally compromised trees will not fail in future weather events; (c) that stumps will not produce secondary growth from surface roots in species prone to suckering; or (d) the condition or behavior of any tree, branch, root system, or stump that was not part of the work performed.
9. Limitation of Liability
To the maximum extent permitted by Florida law, Tree Impressions' total liability to the customer for any claim arising out of or related to the services, regardless of the form of the claim (whether contract, tort, or otherwise), is limited to the amount actually paid by the customer for the specific service giving rise to the claim.
In no event will Tree Impressions be liable for any indirect, incidental, consequential, special, or punitive damages — including without limitation lost profits, loss of use, business interruption, or property value diminution — even if Tree Impressions has been advised of the possibility of such damages. Nothing in this section limits liability for gross negligence, willful misconduct, or any liability that cannot be limited under applicable Florida law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Tree Impressions and its officers, members, employees, and contractors from and against any third-party claims, damages, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) inaccurate or incomplete property information you provided; (b) damage to third-party property caused by your failure to inform us of the property's location or condition; or (c) interference by you or your guests with the work area or crew during performance of the services.
11. Governing Law
These Terms and any dispute arising out of or related to the services or this agreement are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Florida law applies regardless of where you reside or where the website is accessed from.
12. Dispute Resolution
The parties will attempt in good faith to resolve any dispute informally before pursuing litigation. If informal resolution fails, any litigation arising out of or related to these Terms or the services will be brought exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to the personal jurisdiction of those courts.
13. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, will be severed from these Terms. The remaining provisions will continue in full force and effect.
